Joe Consumer:
1. Cannot survive with shrink-wrap COTS disclaimers that bear no responsibility for defective software,
2. Will have little or no legal rights against defective COTS software under UCC 2B as it currently is written,
3. Has been left holding the bag by his state or may soon be (Y2K),
4. May be left holding the bag by his US Government if liability limiting laws are enacted (Y2K),
5. Is about to be left holding the bag by his insurance company (Y2K), and
6. May someday find that those Y2K laws and the lack of insurance protection get broadened to exclude liability for non-Y2K COTS problems.
