Finjan should have sent you to complain to me in the first place instead of trying to feed me to your lawyers. In partnership with the former GTSOM sys admin, I have handled past complaints about the HAHP according to their merits. For example, when Ruby Zefo, one of Sun's lawyers with a good sense of humor, complained about my adorning the HAHP with their mascot Duke, I nuked Duke (as you may have seen). We laughed about it, and Sun was satisfied as well. Unlike your lawyer, she had a legitimate reason to complain, but she handled it with skill and without the misrepresentations to Georgia Tech, the implied threats of litigation, and the backstabbing strong arm tactics characteristic of Finjan's counsel. She wrote to me directly, politely spelled out the facts, and was very civilized. Obviously she's wise enough to know which tactics often backfire and truly give companies a black eye and a bad reputation. Had Finjan allowed you to contact me in a civilized fashion (as seems to be in your character), we could have talked about things more sensibly and without rancor. After you made your points to me, you would have found me readily agreeing to place a link to your response. I'm still willing to do that, but your lawyer has made it a little more difficult to carry out. In order for me to do so, Finjan must meet all of the following conditions: 1. Finjan's response should appear on Finjan's web site. I don't want to be responsible for posting it on the HAHP and run the future risk of being accused of editing it in any way by your attorney. The link to your document will appear on the same page as the link to drowning.html. I'll also change the HAHP to point only to the page with links to both documents, and I'll add at least one link to Finjan's document from drowning.html. Once you send me the URL of Finjan's document, I'll read it carefully. Your document should address the technical issues and should neither repeat any of your attorney's false accusations nor add any falsehoods about my web pages and their hosts. I don't feel obliged to recommend tall tales about myself. You may, of course, quote what I wrote and respond to it as you see fit. 2. Finjan should privately admit that their attorney's accusations are, in their more thoughtful opinion, just plain false and that their attorney's methods were morally wrong and indefensible. This frank admission should be sent to the Associate Director of the Georgia Tech School of Mathematics, Dr. Alfred D. Andrew. It may be sent either by e-mail to andrew@math.gatech.edu or by post to Dr. Alfred D. This is not meant to embarrass Finjan in any way, but simply to set the record straight at the Georgia Tech School of Math. Finjan need say nothing more about this in public, and neither will I. 3. Since RST now hosts the HAHP, they will have to agree to update it on my behalf. Once items 1 and 2 are done, I'll send them the appropriate new pages for http://www.rstcorp.com/hostile-applets. Given the reprehensible way that Finjan's attorney has acted, this strikes me as a fair and reasonable way to set matters straight. I will then regain some measure of respect for Finjan, and perhaps in my spare time I can take a look at more recent versions of Finjan software. Mark
